Welcome to Pixel & Beam Creations. The terms “we,” “us,” and “our” refer to Pixel & Beam Creations. We operate pixelandbeam.ca and the related content, features, products, tools, and services offered through the website (collectively, the “Services”).
Our website is built using WordPress and WooCommerce. These technologies help us operate the website and online store, but Pixel & Beam Creations remains the independent seller and operator of the Services.
These Terms of Service, together with the policies referenced below, describe your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. They contain important provisions concerning custom orders, intellectual property, warranty disclaimers, limitations of liability, and governing law.
By accessing, interacting with, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your province, territory, state, or country of residence. If you permit a minor dependent to use the Services on a device or account you control, you are responsible for that use to the extent permitted by applicable law.
To browse our online store, create an account, or purchase products or services, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent that the information you provide is accurate, current, complete, and that you have the legal right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your customer account to another person.
Our Products
We make reasonable efforts to accurately display and describe our products and services. However, colours, brightness, proportions, engraving appearance, print appearance, materials, and other visual details may look different on your device because of screen settings, photography, lighting, and normal production variations.
Many of our products are personalized, engraved, printed, handmade, or made to order. Minor differences in material texture, grain, colour, positioning, engraving depth, or print finish may naturally occur and will not necessarily be considered defects where the product remains reasonably consistent with its description and approved design.
Product descriptions, materials, specifications, pricing, and availability may change without notice. We may discontinue a product or limit quantities available to a person, geographic area, or jurisdiction where reasonably necessary.
Orders
When you submit an order, you are making an offer to purchase. Pixel & Beam Creations may accept, reject, place on hold, or cancel an order where reasonably necessary, including for product unavailability, suspected fraud, payment issues, prohibited content, pricing errors, or an inability to complete the requested customization.
An order is accepted after payment has been successfully processed and we confirm that the order can be fulfilled. For a custom product requiring a design preview, production begins only after the customer approves the preview.
Please review all product selections, names, dates, spellings, sizes, colours, photographs, logos, and customization details before submitting an order. Once production begins, cancellations or changes may not be possible.
If we reject, change, or cancel an order, we will attempt to contact you using the email address, billing details, or phone number supplied during checkout.
Purchases are also subject to our Refund & Return Policy and Shipping Policy.
Unless a wholesale, corporate, fundraising, or resale arrangement has been separately approved by us, products purchased through the retail website are intended for personal, household, or gift use and not for unauthorized commercial resale or export.
Prices and Billing
Unless otherwise stated, prices are displayed in Canadian dollars (CAD). Prices, discounts, and promotions may change without notice. The amount charged will be the amount shown during checkout and confirmed in your order confirmation, subject to correction of an obvious pricing or system error.
Unless expressly stated, listed prices do not include applicable taxes, shipping charges, customs duties, import taxes, brokerage fees, or other government or carrier charges.
Promotions may be governed by additional conditions. If a promotion-specific condition conflicts with these Terms, the promotion-specific condition will apply to that promotion.
You agree to provide accurate and complete billing, payment, account, and contact information and to update that information when necessary. You confirm that you are authorized to use the payment method submitted and that you will pay all authorized charges, applicable taxes, and shipping costs.
Payments may be processed by third-party payment providers integrated with our WordPress and WooCommerce store. Those providers may apply their own terms, security procedures, privacy notices, and non-refundable processing fees.
Shipping and Delivery
Production and delivery dates are estimates unless we expressly confirm otherwise in writing. Shipping transit begins after production and packaging have been completed and the carrier has accepted the shipment.
Carrier delays, customs processing, severe weather, labour disruptions, remote-area limitations, natural disasters, and other events outside our reasonable control may affect delivery. We will provide reasonable assistance with carrier investigations or claims where possible.
After a shipment has been accepted and scanned by the carrier, the carrier manages transportation and delivery. Nothing in these Terms removes any responsibility or customer remedy that cannot legally be excluded.
Complete shipping rates, delivery estimates, address responsibilities, customs information, local-delivery terms, and claim procedures are set out in our Shipping Policy.
Intellectual Property
6.1 Ownership of Website Content
Unless otherwise stated, content available on pixelandbeam.ca—including our business name, logos, branding, product photographs, graphics, illustrations, original designs, mockups, videos, written content, product descriptions, website layout, and digital assets—is owned by or licensed to Pixel & Beam Creations and is protected by applicable Canadian and international intellectual-property laws. Content owned by customers, suppliers, or other third parties remains the property of its respective owner.
6.2 Permitted Use
You may use this website for lawful personal shopping, approved business purchasing, and informational purposes. Without prior written permission from Pixel & Beam Creations or the applicable rights holder, you may not copy, reproduce, modify, download, republish, distribute, sell, license, publicly display, or commercially exploit protected website content.
You may share unaltered links to publicly available website pages or social-media posts provided that Pixel & Beam Creations is properly identified.
6.3 Pixel & Beam Creations Branding
The name Pixel & Beam Creations, our logo, slogans, and other brand elements may not be used in a way that falsely suggests sponsorship, endorsement, partnership, authorization, or affiliation. Nothing on this website grants a licence to use our business name, logo, trademarks, or branding except where expressly authorized in writing.
6.4 Custom Designs and Artwork
Original designs, templates, layouts, product mockups, proofs, production files, and artwork created by Pixel & Beam Creations remain our intellectual property unless ownership is expressly transferred by a separate written agreement.
Purchasing a personalized product transfers ownership of the physical product only. It does not automatically transfer ownership of the underlying design, editable file, template, production file, photograph, or other intellectual property used to create it.
6.5 Customer-Submitted Content
When you submit photographs, logos, names, artwork, text, designs, or other material for a custom order, you confirm that:
- You own the material or have permission from the owner to use it.
- The material does not violate another person’s copyright, trademark, privacy, publicity, or other legal rights.
- Pixel & Beam Creations may use, reproduce, edit, resize, crop, print, engrave, or otherwise process it as reasonably necessary to prepare, produce, quality-check, support, and fulfil the order.
You retain ownership of your original customer-submitted content and grant us only the limited, non-exclusive licence necessary to perform the requested services. We may refuse, suspend, or cancel an order that we reasonably believe contains unauthorized, unlawful, counterfeit, defamatory, hateful, abusive, or infringing material.
6.6 Product Photographs and Portfolio Use
We will not intentionally publish private photographs, names, or identifiable customer content for advertising or portfolio purposes without permission. Where permission is granted, we may display photographs of the completed product on our website, social-media pages, advertisements, or portfolio. Permission may be withdrawn for future use by contacting us, although material already printed, distributed, or published may not always be removable.
6.7 Third-Party Intellectual Property
Third-party names, logos, characters, photographs, trademarks, and copyrighted works remain the property of their respective owners. A reference to a third-party brand does not imply sponsorship, authorization, endorsement, or affiliation unless expressly stated. Pixel & Beam Creations cannot grant permission to use intellectual property owned by another person or organization.
6.8 Reporting Intellectual-Property Concerns
To report a potential infringement, email support@pixelandbeam.ca and include your contact information, identification of the protected work or trademark, identification of the disputed content, an explanation of your ownership or authority, and relevant supporting documentation or links.
We may remove, restrict, or disable disputed content while a legitimate complaint is reviewed.
6.9 Reservation of Rights
All rights not expressly granted in these Terms are reserved by Pixel & Beam Creations and the applicable intellectual-property owners.
Optional Tools
We may provide access to tools, plugins, integrations, or services supplied by third parties. We do not necessarily control, monitor, or endorse those third-party tools.
Third-party tools are provided on an “as is” and “as available” basis to the extent permitted by law. Your use of them is at your discretion and may be governed by the provider’s own terms, privacy policy, licences, fees, and service conditions.
New website features, resources, integrations, and tools introduced in the future will form part of the Services and will be subject to these Terms unless separate terms are displayed.
Third-Party Links
The Services may contain links, embedded features, or materials supplied by third parties. We are not responsible for independently examining or guaranteeing the accuracy, security, availability, legality, or practices of a third-party website or service.
If you leave pixelandbeam.ca or complete a transaction with a third party, you do so subject to that third party’s terms and policies. Questions, complaints, or claims concerning third-party products or services should be directed to the applicable provider.
Relationship with WordPress and WooCommerce
Pixel & Beam Creations independently owns and operates pixelandbeam.ca. The website uses WordPress as its content-management system and WooCommerce as its e-commerce software.
Pixel & Beam Creations is not owned, operated, sponsored, endorsed by, or officially affiliated with WordPress, the WordPress Foundation, WooCommerce, Woo, or Automattic Inc.
WordPress, WooCommerce, Woo, and their respective names, logos, trademarks, and related brand materials belong to their respective owners. References to them identify technologies used to operate the website and online store.
Third-party software, themes, plugins, hosting services, payment processors, and integrations may be governed by their own terms, privacy policies, licences, and service conditions.
Pixel & Beam Creations remains responsible for the products, orders, customer service, policies, and business content offered through pixelandbeam.ca. WordPress, WooCommerce, Woo, and Automattic Inc. are not the sellers of our products and are not responsible for our orders, refunds, shipping, customer transactions, or business operations.
Privacy Policy
Personal information collected through the Services is handled according to our Privacy Policy and applicable law.
Our website may use WordPress, WooCommerce, hosting services, payment processors, analytics tools, security providers, email services, shipping integrations, and other third-party technologies. Information may be processed by those providers only as necessary to operate the website, process payments, fulfil orders, prevent fraud, provide support, and perform the activities described in our Privacy Policy.
WooCommerce is e-commerce software and is not, by itself, the host of pixelandbeam.ca. The specific providers that receive or process information may change as our technology and service arrangements change.
Feedback
If you submit a public review, suggestion, idea, proposal, or other voluntary feedback about our business or Services (“Feedback”), you grant Pixel & Beam Creations a non-exclusive, worldwide, royalty-free licence to reproduce, quote, publish, adapt, and display that Feedback for customer service, promotional, operational, or commercial purposes, subject to applicable law.
This Feedback licence does not apply to private photographs, logos, artwork, names, or other files submitted solely for a custom order. Customer-submitted order content is governed by Section 06 and our Privacy Policy.
You confirm that you have the rights needed to submit the Feedback, that it is accurate to the best of your knowledge, and that any compensation or incentive connected with the Feedback has been disclosed where required.
We may moderate or remove Feedback that we reasonably believe is unlawful, fraudulent, threatening, defamatory, obscene, abusive, infringing, misleading, or unrelated to a genuine customer experience. We are not required to maintain Feedback in confidence, pay compensation for it, or respond to it unless we separately agree in writing.
Errors, Inaccuracies and Omissions
We make reasonable efforts to keep pixelandbeam.ca accurate and current. However, the website may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, images, dimensions, pricing, promotions, availability, shipping charges, production estimates, or delivery information.
We may correct errors and update information when identified. If an error materially affects an order already submitted, we may contact you to confirm corrected information, offer a reasonable alternative, adjust or cancel the affected portion, or provide an appropriate refund.
Product colours, sizes, dimensions, textures, and appearance may differ slightly because of screen settings, photography, natural material differences, manufacturing tolerances, and the handmade or personalized nature of some products.
Nothing in this section limits any right or remedy available under applicable consumer-protection law.
Prohibited Uses
You may use pixelandbeam.ca only for lawful purposes. You must not use our website, products, Services, or content:
- For an unlawful, fraudulent, deceptive, abusive, or malicious purpose.
- To violate an applicable federal, provincial, territorial, state, local, or international law or regulation.
- To infringe the copyright, trademark, privacy, publicity, or other legal rights of Pixel & Beam Creations or another person.
- To submit photographs, logos, artwork, characters, designs, text, or other material you do not own or have permission to use.
- To place fraudulent orders, use stolen payment information, impersonate another person, or submit false account, billing, payment, or delivery information.
- To upload or distribute malware, viruses, malicious code, or other harmful technology.
- To gain unauthorized access to accounts, servers, databases, administrative areas, or connected systems.
- To bypass or interfere with security, access-control, payment, authentication, or fraud-prevention measures.
- To scrape, harvest, copy, or monitor website content or customer data through unauthorized automated or manual methods.
- To send spam, phishing messages, unsolicited promotions, or unauthorized electronic communications.
- To harass, threaten, abuse, discriminate against, defame, or harm Pixel & Beam Creations, our customers, providers, or another person.
- To request or submit content that is unlawful, threatening, hateful, exploitative, obscene, invasive of privacy, or otherwise reasonably considered inappropriate.
- To disrupt another person’s use of the website or the proper operation of the store.
- To commercially exploit our website content, photographs, designs, mockups, or branding without written permission.
- To falsely suggest sponsorship, endorsement, authorization, partnership, or affiliation.
- To assist or encourage another person to engage in prohibited activity.
We may refuse service, reject or cancel an order, restrict access, close an account, or report suspected unlawful conduct when we reasonably believe these Terms have been violated.
If an order is cancelled because the customer submitted prohibited or unauthorized content, refund eligibility may take account of work completed, materials used, payment-processing costs, our Refund & Return Policy, and applicable law.
No Agency Relationship
Nothing in these Terms, your use of pixelandbeam.ca, or your purchase of a product creates a partnership, joint venture, employment, franchise, fiduciary, representative, or agency relationship between you and Pixel & Beam Creations.
Customers, website users, contractors, suppliers, affiliates, and other third parties may not act on our behalf, enter agreements in our name, change our policies, approve refunds, guarantee delivery dates, or create obligations for Pixel & Beam Creations unless expressly authorized in writing.
We may use independent contractors, shipping carriers, payment processors, website providers, and other service providers. Those providers act according to their own responsibilities and are not authorized to make commitments on our behalf unless we expressly approve them.
Termination
These Terms remain effective while you access or use the Services.
You may stop using pixelandbeam.ca at any time. You may request closure of your customer account, subject to outstanding orders, payments, disputes, fraud-prevention needs, and legal recordkeeping requirements.
We may suspend access, close an account, refuse service, or cancel an order when we reasonably believe that a user has violated these Terms, engaged in unlawful or harmful conduct, supplied unauthorized payment information, submitted infringing content, interfered with website security, or created a material risk to Pixel & Beam Creations, our customers, or another person.
Where reasonably possible, we may provide notice. Immediate action may be taken where necessary to prevent fraud, security threats, unlawful activity, or harm.
Closing an account or terminating website access does not automatically cancel a custom order already in production. Cancellation and refund eligibility remain subject to our Refund & Return Policy and applicable law.
Sections concerning intellectual property, customer content, outstanding payment obligations, indemnification, limitations of liability, dispute resolution, governing law, and any provision that by its nature should survive will continue to apply after termination.
Disclaimer of Warranties
To the maximum extent permitted by applicable law, pixelandbeam.ca and its website content, features, and online services are provided on an “as is” and “as available” basis.
We do not guarantee that the website will always be available, uninterrupted, completely secure, error-free, compatible with every device or browser, or free from harmful components. We may temporarily restrict access for maintenance, security updates, technical issues, or circumstances outside our reasonable control.
Product Information and Appearance
We make reasonable efforts to present products accurately. Actual colours, brightness, positioning, engraving depth, print appearance, dimensions, and materials may vary because of screen settings, lighting, photography, material grain or texture, manufacturing tolerances, production processes, and the handmade or personalized nature of a product.
Digital proofs and website mockups are visual representations and may not perfectly reproduce a physical finished product. Minor variations that do not materially affect intended appearance, quality, or function will not necessarily be considered defects.
Customer-Submitted Content
Customers are responsible for reviewing names, dates, spelling, photographs, logos, measurements, colours, and customization details. We cannot guarantee the quality of a result created from a low-resolution, blurred, dark, incorrectly sized, cropped, or otherwise unsuitable customer file.
Where reasonably possible, we may alert a customer when a file appears unsuitable. Final responsibility for approving a design proof and confirming personalization details remains with the customer. Approval authorizes production according to the approved proof.
Third-Party Services
The website may depend on WordPress, WooCommerce, hosting providers, payment processors, carriers, plugins, and integrations. We cannot guarantee the continuous availability, performance, or security of services controlled by third parties.
Consumer Rights Preserved
Except for express written warranties and rights that apply automatically under law, other representations, conditions, and warranties are disclaimed only to the extent legally permitted. Nothing in these Terms excludes, limits, or replaces a statutory warranty, consumer guarantee, remedy, or legal right that cannot lawfully be excluded or limited.
Limitation of Liability
To the maximum extent permitted by applicable law, Pixel & Beam Creations, including its owner, employees, contractors, representatives, and service providers, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from:
- Your use of or inability to use pixelandbeam.ca.
- Website interruptions, technical errors, security incidents, or unavailable features.
- Errors, inaccuracies, or omissions in website content.
- Interruptions involving payment processors, hosting providers, carriers, WordPress, WooCommerce, plugins, or other third-party services.
- Loss of data, revenue, profit, opportunity, goodwill, or anticipated savings.
- Unauthorized account access caused by failure to protect login information.
- Misuse, unauthorized alteration, or improper handling of a product after delivery.
- Customer-submitted photographs, artwork, logos, wording, measurements, instructions, or other content.
Products and Custom Orders
We are not responsible for customization errors submitted or approved by the customer, including incorrect names, spelling, dates, photographs, measurements, colours, or design instructions. Once an approved custom order enters production, changes may not be possible.
Shipping and Third-Party Services
Production and delivery dates are estimates unless expressly confirmed in writing. We are not liable for delays or interruptions caused by circumstances outside our reasonable control, including carrier delays, severe weather, customs, labour disruptions, internet outages, equipment failure, supply shortages, or third-party service interruptions.
Nothing in this section limits a responsibility that we may have under law for properly preparing, packaging, and dispatching an order.
Maximum Liability
If Pixel & Beam Creations is found legally responsible for a claim, our total liability will, to the maximum extent permitted by law, be limited to the amount paid for the specific product or service giving rise to the claim. Where required by law, an appropriate remedy may instead include repair, replacement, correction, refund, or another legally required remedy.
Exceptions
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where liability cannot be limited, death or personal injury where liability cannot be excluded, breach of a statutory warranty, or another right or liability that cannot legally be waived or limited.
Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Pixel & Beam Creations, its owner, employees, contractors, representatives, and service providers from reasonable third-party claims, losses, liabilities, damages, costs, and reasonable legal expenses arising directly from:
- Your material breach of these Terms.
- Your unlawful, fraudulent, abusive, or unauthorized use of the website, products, or Services.
- Photographs, logos, artwork, text, designs, or other material you submit for a custom order.
- A claim that customer-submitted material infringes copyright, trademark, privacy, publicity, or another legal right.
- False or misleading account, payment, billing, or delivery information supplied by you.
- Your misuse, unauthorized alteration, resale, or improper handling of a product after delivery.
- Your violation of applicable law or another person’s rights.
This obligation applies only to the extent the claim or expense was caused by your conduct, instructions, content, or breach. We will provide reasonable notice where possible and you agree to provide reasonable cooperation. You may not settle a claim in a way that admits wrongdoing by or imposes obligations on Pixel & Beam Creations without our prior written consent.
This section does not require you to indemnify us for loss caused by our own fraud, wilful misconduct, negligence, or breach of a legal obligation that cannot be excluded.
Severability
If a provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, it will be interpreted, modified, or limited only to the minimum extent necessary to make it valid and enforceable.
If it cannot reasonably be modified, the affected provision will be removed without affecting the validity or enforceability of the remaining provisions.
Waiver; Entire Agreement
Our failure to exercise or enforce a right or provision of these Terms does not waive that right or provision.
These Terms, together with the policies and operating rules expressly incorporated by reference, constitute the entire agreement between you and Pixel & Beam Creations concerning use of the Services and supersede prior or contemporaneous discussions, communications, or proposals concerning the same subject matter.
A rule that an ambiguity must be interpreted against the drafting party will not apply except where applicable law requires otherwise.
Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without prior written consent from Pixel & Beam Creations.
We may assign or transfer our rights and obligations in connection with the sale or transfer of all or part of the business, a merger or restructuring, a transfer of assets, a change in ownership, or the appointment of a successor responsible for applicable operations.
An assignment by Pixel & Beam Creations remains subject to applicable law and will not remove or materially reduce customer rights that cannot legally be excluded. Where reasonably required, affected customers will be notified of a transfer involving an active order, account, or ongoing service.
Governing Law
These Terms, your use of pixelandbeam.ca, and purchases from Pixel & Beam Creations are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable in Saskatchewan, without regard to conflict-of-law principles.
Subject to consumer rights and jurisdictional protections that cannot legally be waived, disputes arising from these Terms, the website, or a purchase will be brought before a court of competent jurisdiction in Saskatchewan, Canada.
Before starting formal proceedings, both parties agree to make reasonable efforts to resolve the dispute through direct communication and good-faith negotiation.
Customers outside Saskatchewan may have mandatory protections under the laws of their own province, territory, state, or country. Nothing in these Terms removes a consumer-protection, statutory-warranty, remedy, or jurisdictional right that cannot lawfully be waived.
The United Nations Convention on Contracts for the International Sale of Goods will not apply to the extent its application may lawfully be excluded.
Headings
Section headings are included for convenience and organization only. They do not limit or change the meaning of these Terms.
Changes to Terms of Service
We may update these Terms when reasonably necessary to reflect changes to our products, business practices, website features, payment methods, shipping options, applicable laws, security requirements, or third-party providers.
The current version will be posted on pixelandbeam.ca with an updated effective date. Where a change is material and affects existing rights or obligations, we may provide reasonable notice through the website, by email, or through another appropriate method.
Unless otherwise stated, revised Terms take effect on the date displayed. Continued use after that date means you accept the revised Terms. If you do not accept them, you should stop using the website.
Existing Orders
Orders placed before revised Terms take effect will generally remain subject to the Terms that applied when the order was placed, unless a change is required by law, the customer agrees to the change, the change provides an additional benefit or protection, or applying the former provision is no longer legally or practically possible.
We will not use an update to unfairly remove or materially reduce rights relating to an accepted and paid order.
Changes to Products and Services
We may modify, suspend, replace, or discontinue website features, products, or services and may change availability, specifications, designs, materials, prices, promotions, shipping options, and production estimates.
If an accepted order cannot be fulfilled because a product or service has been discontinued or materially changed, we may offer a comparable replacement, a revised product or design, store credit accepted by the customer, or a refund for the affected portion.
